1. General Terms

A. By booking an appointment with SDJ Creative, you, the client, are subject these full terms and conditions.

B. SDJ Creative reserves the right to amend, vary or cancel these terms and conditions at any time.

 

2. Booking Deposit/Fee/Cancellation

A. All appointments require either full payment or a deposit before the session in order to secure your place, unless stated otherwise.  Deposits will be deducted from your session fee.  Payments can be made by bank transfer or cash.

B. You may, subject to availability, be able to reschedule your session at no extra charge if enough notice is given.  If you fail to turn up for an appointment or cancel your session SDJ Creative reserves the right to retain all monies paid.

C. If SDJ Creative has to cancel an appointment, an alternative date will be offered where possible.  Where not possible, SDJ Creative's liability shall be limited to a full refund of the monies paid. At least 5 days notice is required for client cancellations.  An alternative date will be  offered where possible but not guaranteed.

 

3. Device Usage

The use of cameras, phones or other devices capable of taking still images or recording video is not permitted during the session.

 

4. Model Release

The client grants all necessary permissions to allow SDJ Creative the use of any images created from the session to be used in all forms of media for promotion, advertisements or marketing.

 

5. Liability

SDJ Creative  takes all reasonable efforts to protect client images, however, any liability for loss or damage of any image is accordingly limited to re-photographing.

 

6. Proof Images and Ordering

A. A password protected , on-line gallery of proof images will be published within 2-3 weeks of the appointment date.  This will contain anywhere from 15 images upwards from an average session.  The average from a newborn session is 25-30.  In both instances, this number is dependent upon factors such as weather and willingness/co-operation of subjects.  If the total number of images is above or below the average amount no credit will be given or additional charges applied.  Images will remain online in a secure gallery for 2 weeks from the upload date.  It is not possible to extend the gallery duration.

B. All images will be archived once the gallery expires, and any images requested from the archive will be subject to a £20 administration fee.  SDJ Creative deletes all archives after a period of 6 months, so it is strongly suggested that clients back up purchased images to a secure location.

C. It is illegal to reproduce, screenshot, print or save watermarked images from the gallery.

D. Any replacement discs will be subject to a £25 replacement/administration fee.

E. Images not ordered within one month of completion will be deleted.

F. Payment for items ordered must be made in full at the time of ordering.

 

7. Print Release

A. Copyright of all images remains the property of SDJ Creative.

B. The client may reproduce, print, enlarge or display purchased images for personal, non-commercial use only.  (This excludes agency headshots/body shots which may be used commercially upon purchase of a commercial licence at a cost of £15.)

 

8. Edited Images

A. Images may not be altered in any way, with the exception of cropping.

B. As edited images are a reflection of SDJ Creative’s style, SDJ Creative does not provide clients with copies of unedited images.  Unedited images are deleted as part of the editing process.

C. Minor blemishes, bruises, etc will be removed as part of the editing process, but any requests for further editing may be subject to additional charges.

 

9. Gift Voucher Terms

A. Gift vouchers must be used by the stated expiry date.  Any unused balance will not be credited or refunded on expiry.

B. Gift vouchers are non transferable and are only for the use of the intended recipient and their family.

C. Gift vouchers have no cash value and no change will be given.

D. You must provide SDJ Creative with the gift voucher reference when you book your session.

E. Gift vouchers must be brought to your session.

 

10. Privacy Policy

A. SDJ Creative will only use the information collected about you lawfully (in accordance with the Data Protection Act 1998).

B. SDJ Creative only collects information about you to process your booking and orders, and to provide you with the best possible service.

C. SDJ Creative will never pass your details to any third parties unless required by law to do so.
